Marisela Herrera et al. v. JFK Medical Center Limited Partnership et al.

Civil Action No. 8:14-cv-2327 (M.D. Fla.)

The parties have reached a proposed class action settlement, and are seeking court approval of the proposed Settlement. This case is about charges by hospitals affiliated with HCA Healthcare, Inc. in Florida to patients with Personal Injury Protection Insurance (“PIP Insurance”) for emergency room services. If the Settlement is approved, going forward, hospitals affiliated with HCA Healthcare, Inc. in Florida will provide their uninsured discount to patients who receive emergency services, lack secondary insurance coverage or a personal injury settlement relating to the accident, and have a remaining balance after their PIP Insurance pays a portion of their medical bill. The Settlement will not preclude the bringing of individual claims asserting damages related to the reasonableness of the past or future charges for medical services provided by HCA-affiliated hospitals.

The purpose of the Notice is to inform you of this lawsuit, the proposed Settlement, your rights and options, and to alert you that the Court will hold a Fairness Hearing to consider this Settlement and related matters on December 13, 2018, at 9:15 a.m. at the United States District Courthouse, Middle District of Florida, 801 North Florida Avenue, Courtroom 17, Tampa, Florida 33602.

Receive Settlement Benefits No action on your part is required to benefit from the Settlement.
Object Write to the Court about why you object to the Settlement. The deadline to object to the Settlement is November 15, 2018.
Go to a Hearing If you wish to speak at the Fairness Hearing, you must file a Notice of Intent to Appear no later than November 28, 2018. The Fairness Hearing will take place on December 13, 2018, at 9:15 a.m..
